Your privacy is important, so Tutor Tech Group, Inc. has created this Privacy Policy to let you know what information we collect when you visit the mySTEMtutor.com web site (the “Site”), why we collect it, and how it is used. The terms “you,” “your” and “yours” refer to all visitors of our Site. The terms “TTG”, “we”, “us” and “our” refer to Tutor Tech Group, Inc. This Privacy Policy is governed by our Terms of Use. By accessing this Site and the content, information, products and services available on this Site, you consent to the data practices described in this Privacy Policy and our Terms of Use. We may periodically make changes to this Privacy Policy, in which case we will post the revised Privacy Policy on this Site and update the date listed at the very bottom of this web page, and they will be effective upon posting. It is your responsibility to review this Privacy Policy frequently and remain informed about any changes, so we encourage you to visit this page often. If you do not consent to this Privacy Policy, please do not use the Site.

1. The Collection of Information

The Information We Collect; How We Collect It

We request that you voluntarily supply us with personal information. Personal information includes any information that may be used to identify a specific individual. Generally some or all of this information is requested when you register on the Site, when we conduct interviews of prospective tutors, when we procure background checks on our TUTORS, when you provide tutor reviews, or when you provide information in connection with using the Site to undertake transactions. For our CLIENTS (the folks registering and purchasing tutoring services), that collection of information includes, but is not limited to: a first and last name, home address or other physical address, an email address, contact phone number(s), and, if someone other than the CLIENT is being tutored, the first name of the individual being tutored. For our TUTORS (the folks we feature and whose tutoring services we promote on our Site), that collection of information includes, but is not limited to: a first and last name, home address or other physical address, an email address, contact phone number(s), date of birth, social security number, student ID card number, driver’s license number and state of issue, official academic transcripts, a recent photo, and bank information for processing tutoring fee payments.

We request that CLIENTS voluntarily provide us with personal information about the individual being tutored if that is someone other than the CLIENT. To the extent that other individual is a child under 18, we ask for their first name only so that we may track their progress and tutoring history for the CLIENT and to inform the TUTORS tutoring that individual. Parents of children under the age of 13 are welcome to email us at [email protected] to review any identifiable information we have collected about your child. If you desire, you may request that we delete this information and/or specify that we collect no more of your child's information. Please note that we will need to verify the identity of anyone requesting information about a child to ensure that the person is in fact the child's parent or legal guardian, and that a request for us to delete or cease collecting all personal information about a child means that child’s tutoring history is no longer accessible for review by you or TUTORS.

For prospective tutors and existing TUTORS, we ask for a TUTOR’s gender, existence of a criminal background, GPA, educational level attained and educational institutions attended, major/area of specialization, and current academic status. We collect written answers to short personal essay type questions. We obtain background checks through a vendor (currently GoodHire LLC, www.goodhire.com, P.O. Box 391146, Omaha, NE 68139, 1-888-906-7351) which requires us and/or our vendor to ask for and collect your personal information, including your name, email address, date of birth, social security number and a current address. Please visit the web site of GoodHire LLC to familiarize yourself with their privacy policy and practices. We require TUTORS to provide us with official academic transcripts from some or all undergraduate and/or graduate institutions attended.

When you (CLIENT) pay for tutoring services with your credit card, we use a payment processing firm, currently Stripe, which will ask you for your personal information in the course of processing payments on your credit card. TTG does not collect that information, and this Privacy Policy does not control the collection and use of your payment related information. Please visit Stripe’s web site (stripe.com) to familiarize yourself with their privacy policy and practices. TTG will pay you (TUTOR) your fee for a successfully delivered (and non-refunded) tutoring session via PayPal. This Privacy Policy does not control the collection and use of your payment related information by Paypal. Please visit PayPal’s web site to familiarize yourself with their privacy policy and practices.

Some of the information TTG collects is not explicitly submitted by you – TTG also automatically receives and records information on its server logs from your browser, including your IP address, cookie information, the web pages you request, your browser type and language, access times, the searches you undertake, and the referring web site address.

For instance, when you visit our Site, we may assign your computer one or more cookies, to facilitate access to our Site and to personalize your online experience. Through the use of a cookie, we also may automatically collect information about your online activity on our Site, such as the web pages you visit, the links you click, and the searches you conduct on the Site. Most browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies, and you should be able to remove existing cookies by following your browser help file directions. If you choose to decline cookies, please note that you may not be able to sign in or use some of the interactive features offered on our Site.

We also may use standard other technologies, such as web beacons and other similar technologies, to track your use of our Site. We also may include web beacons in promotional or other e-mail messages or newsletters to determine whether messages have been opened and acted upon. The information we obtain in this manner enables us to customize the Services we offer our Site users and to measure the overall effectiveness of our Services, Site or other activities.

The Information Collected by Third Parties Using Technology

Our third party vendors use cookies to serve ads based on your prior visits to the Site and various non-personally identifiable information they may collect. 2. How We Use Your Information

With respect to our CLIENTS, generally, we may use information that we collect about you to:

  • deliver the Services that you request (for instance, display TUTORS to you based on their geographic proximity and the type of tutoring requested and maybe by preference for female or male);
  • inform a prospective TUTOR of your first name and home address for purposes of their commute to your residence or location for a Tutor Session;
  • inform a prospective TUTOR regarding the tutoring history of, and progress made by, the individual being tutored; process your Tutoring Service transactions and send you administrative messages regarding the rendering and successful completion of Tutoring Sessions;
  • alert you to an imminent Tutoring Session via a text to your phone;
  • alert you to the successful completion of a Tutoring Session and invoice you for the fee then due;
  • manage cancellations by CLIENTS or TUTORS, and in the case of TUTORS, seek to identify a substitute TUTOR;
  • manage your user account and provide you with customer support;
  • Tracking your CLIENT history (including TUTOR reports from completed Tutoring Sessions regarding the progress of the individual who received the Tutoring Service);
  • send you newsletters about our Services and new offerings;
  • perform research and analysis about your use of our Site and Services;
  • manage our business;
  • enforce our terms and conditions; and
  • perform functions as otherwise described to you at the time of collecting your information.

With respect to our TUTORS, generally, we may use information that we collect about you to:

  • evaluate your qualifications as a prospective tutor deserving of being featured as a TUTOR on this Site;
  • have performed a background check by a reputable third party vendor , currently GoodHire, LLC; enable you to complete and publish on the Site a TUTOR Bio to present yourself professionally to prospective CLIENTS; process your Tutoring Service transactions and send you administrative messages regarding the rendering of Tutoring Sessions; alert you to an imminent Tutoring Session via a text to your phone; confirm your successful completion of a scheduled Tutoring Session and prompt you for an update to the tutored individual’s tutoring history;
  • arrange for payments via PayPal to your personal checking account;
  • manage cancellations;
  • identify and arrange for substitute TUTORS;
  • manage your user account and provide you with customer support;
  • track your Tutoring Sessions history and progress reports for CLIENTS and your records;
  • perform research and analysis about your use of our Site and Services;
  • manage our business;
  • enforce our terms and conditions; and
  • perform functions as otherwise described to you at the time of collecting your information.

3. How We Share or Disclose Your Information

We may share personal or other information we have collected about you or your activities on our Site or while using our Services under the following circumstances.

Personal information

We do not share your personal information with others except as indicated below or when we inform you and give you the opportunity to opt out of having your personal information shared (see below “Controlling Your Personal Information”).

We share the personal information you voluntarily provide to us with other users on our Site for the purpose of facilitating the offer, purchase and rendering of Tutoring Services by and between CLIENTS and TUTORS. This includes, for CLIENTS, displaying a CLIENT’S first name, address, the first name of the individual being tutored, and that individual’s Tutoring Services history and progress, if applicable and appropriate. This includes, for TUTORS, displaying TUTOR Bios on the Site for CLIENTS’ and other users’ perusal.

We may share your personal information in connection with displaying your TUTOR reviews on the Site. Your first name and any personally identifiable information you have included in your reviews may be displayed on the Site in connection with the reviewed TUTOR.

We may share your personal information with our authorized service providers that perform certain services on our behalf. These service providers may have access to personal information needed to perform their functions but are not permitted to share or use such information for any other purposes.

We may disclose your personal information in response to a subpoena or similar investigative demand, a court order, or a request for cooperation from a law enforcement or other government agency; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law. In such cases, we may raise or waive any legal objection or right available to us.

We may disclose your personal information when we believe disclosure is appropriate in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing; to protect and defend the rights, property or safety of our company, our users, our employees, or others; to comply with applicable law or cooperate with law enforcement; or to enforce our Site's terms and conditions or other agreements or policies.

We may disclose your information to subsidiaries and affiliates of TTG.

We may disclose your personal information in connection with a substantial corporate transaction, such as the sale of our business, a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy. The personal information which you provide to us is an asset of TTG and may be included in the assets transferred in the event of a substantial corporate transaction.

There are a number of places on our Site where you may click on a hyperlink to access other web sites that do not operate under this Privacy Policy. Any third parties to whom we may disclose personal information may have their own privacy policies which describe how they use and disclose personal information. Those policies will govern use, handling and disclosure of your personal information once we have shared it with those third parties as described in this Privacy Policy. If you want to learn more about their privacy practices, we encourage you to visit the web sites of those third parties. These entities or their servers may be located either inside or outside the United States.

TTG will notify you when information about you may be provided to third parties in ways other than explained above, and you will have the option to prevent such information sharing.

Aggregated and Non-Personal Information

We may share aggregated and non-personal information we collect under any of the above circumstances. We may also share it with third parties to develop and deliver targeted advertising on third-party web sites. We may combine non-personal information we collect with additional non-personal information collected from other sources. We also may share aggregated information with third parties, including advisors and investors, for the purpose of conducting general business analysis. This information does not contain any personal information and may be used to develop new services that we hope you and other users will find of interest.

We hire vendors to undertake our interest-based advertising and remarketing programs, which allow us to communicate with people who have previously visited key pages on the Site. These third party vendors may show TTG’s “mySTEMtutor” ads on sites on the internet and use cookies to serve ads based on a user's prior visits to the Site.

Other

From time to time, we may wish to use your information for new, unanticipated uses not previously disclosed in this Privacy Policy. If our information practices change at some time in the future to accommodate such desired use, we will post the policy changes to our Site to notify you of these changes and we will use for these new purposes only data collected from the time of the policy change forward. If you are concerned about how your information is used, you should check back at our Site periodically.

4. TUTOR Reviews

We encourage you to generate and submit reviews regarding the TUTORS with whom you transact on this Site. Such postings are governed by our Terms of Use. Whenever you voluntarily disclose personal information on publicly-viewable web pages, that information will be publicly available and can be collected and used by others. For example, if you post your email address, you may receive unsolicited messages. We cannot control who reads your posting or what other users may do with the information you voluntarily post, so we encourage you to exercise discretion and caution with respect to your personal information.

5. Third Party Web Sites

This Site may contain integrations with other sites such as Facebook or Twitter, and there are a number of places on our Site where you may click on a hyperlink to access these sites and other web sites that do not operate under this Privacy Policy. These third-party web sites may independently solicit and collect information, including personal information, from you and, in some instances, provide us with information about your activities on those web sites. We recommend that you consult the privacy policies of all third-party web sites you visit by clicking on the “privacy” link typically located at the bottom of the web page you are visiting.

6. Controlling Your Personal Information

You may elect not to provide us with certain information, but that may result in you being unable to use certain functionality of our Site because such information may be required in order for you to register as a CLIENT or TUTOR; exchange messages and/or undertake transactions for Tutor Services, submit TUTOR reviews; pay or be paid for Tutoring Services; ask a question; or initiate certain other transactions on our Site.

If you are a registered user of our Site, you may update your personal information simply by signing in and going to “My Account” from our home page. You can make changes to your account information at any time. To protect your privacy and security, we will also verify your identity before granting access or making corrections. You may also contact us to communicate any questions or concerns. More information about how to contact us is provided below.

7. How we protect your personal information

We take appropriate security measures (including physical, electronic and procedural measures) to help safeguard your personal information from unauthorized access and disclosure. For instance, only authorized employees are permitted to access personal information, and they may do so only for permitted business functions. The Site encrypts your personal information using secure socket layer (SSL) technology to provide for the secure transmission of the information from your device to our servers. In addition, we use firewalls to help prevent unauthorized persons from gaining access to your personal information. However, although we take steps to secure your information, we do not promise, and you should not expect, that your personal information, searches, or other communications will always remain secure.

8. Children's privacy

You must be 18 to visit and use our Site, and we do not knowingly collect personal information from children under the age of 18, except as follows. Typically, our CLIENTS request that TUTORS provide Tutoring Services to an individual other than the CLIENT, for instance to the CLIENT’s children. Under these circumstances, we collect and use the tutored individual’s first name (only) for the purpose of tracking that individual’s Tutoring Services history and progress.
